The Program / Department / Team
The mission of the Development/ Development Operations department, along with Marketing & Communications, is to advance the organization’s strategic goals and support our worldwide team by raising flexible funds, profile and influence. The team encompasses several dozen dynamic professionals who possess a wide range of skills. We are gift officers, direct response fundraisers, web developers, marketers and media relations strategists. We are database managers, digital specialists, creative designers, storytellers and teachers. Most of all, we are passionate about Mercy Corps’ mission and believe a better world is possible.

The Position
The Fundraising Compliance Officer serves as focal point and “first stop” to support Development and MarComms team members around fundraising and data privacy compliance requirements. This role will be responsible for fulfilling time-bound registrations and fundraising regulatory requirements, while also keeping several projects around systems documentation and compliance moving forward; researching a broad array of ad hoc opportunities as they arise (often in moments of emergency fundraising) while also creating tools and checklists to facilitate analysis and decision-making.

Essential Responsibilities
FUNDRAISING COMPLIANCE

  • Build out fundraising compliance guidance (including topics such as marketing offers, quid pro quo, charitable sales promotion, etc.), ensuring it is kept up-to-date and is made available in user-friendly formats for both internal and external stakeholders
  • Participate in onboarding new fundraising team members and/or external agency partners on Mercy Corps fundraising compliance standards; lead periodic workshops or refresher trainings with relevant stakeholders
  • Complete all necessary paperwork for annual state charitable registrations and coordinate with Mercy Corps vendor to ensure that Mercy Corps remains in compliance to fundraise in all U.S. states. Do the same for Global Impact (vendor for government employee giving programs).
  • Regularly monitor Charity Watchdog sites and provide timely organizational updates
  • Evaluate philanthropic survey opportunities and compile information for participation
  • Evaluate new payment gateways to assess whether they are viable and worthwhile opportunities, including gathering inputs from fundraisers (marketing aspect) and the DevOps Manager (functionality, data flows, etc.)
  • Oversee annual PCI Compliance requirements for Mercy Corps and its vendors
  • Analyze new requirements that impact our fundraising or compliance (such as the recent Mastercard rules around recurring credit card payments) to understand what the requirements are, document how we currently do or do not comply, what changes would be needed, the timeline and lift required to do so, and recommendation on how to proceed
  • Support specialized campaigns and ad hoc donor questions that have a unique fundraising component to them, including working closely with the Community Fundraising Manager to ensure compliance
  • Liaise with Senior Director of DevOps, and internal/external legal counsel as needed, on new areas of compliance

DATA PRIVACY & PROTECTION COMPLIANCE

  • Understand Mercy Corps’ Responsible Data Policy and its associated requirements around Personally Identifiable Information (PII) and Personally Sensitive Information (PSI)
  • Build out, map and maintain documentation around Development and MarComms’ data collection systems, data sharing with external agencies and vendors, and data protection practices
  • Review Development and MarComms contracts for proper data protection clauses
  • Complete Privacy Impact Assessments (PIAs) for new vendors, processes or procedures involving PII or PSI
  • Create tools to ensure compliance with Responsible Data requirements across the Development and MarComms departments
  • Provide information to Senior Director of Development Operations & Analytics to help assess areas of risk and solutions
  • Work with counterparts in Mercy Corps Europe as needed when issues around shared MCG/MCE fundraising data arise

OTHER

  • Project management assistance to Senior Director of Development Operations & Analytics with forthcoming agency CRM project
  • Other duties as assigned and as needed, for example back-up to RD Invoices for certain invoice tasks

Reports Directly To: Senior Director of RD Development Operations & Analytics

Works Directly With: Development team, Marketing & Communications team (especially Mass Market Fundraising), Data Privacy & Protection team

Accountability to Participants and Stakeholders
Mercy Corps team members are expected to support all efforts toward accountability, specifically to our program participants, community partners, other stakeholders, and to international standards guiding international relief and development work. We are committed to actively engaging communities as equal partners in the design, monitoring and evaluation of our field projects.

Minimum Qualification & Transferable Skills

  • College degree or equivalent experience in a related field
  • 2+ years of experience in a non-profit office environment, preferably working with issues on fundraising operations and/or data privacy
  • Familiarity with U.S. state charitable registration and other regulatory fundraising requirements
  • Demonstrated experience with compliance analysis and documentation
  • Ability to manage, organize, synthesize and summarize a large amount of information while making it approachable for other users
  • Proficiency with Microsoft Office Suite, with strong M365 skills
  • Excellent problem solving and interpersonal skills
  • Strong written and spoken communication skills

They will have a demonstrated ability to communicate effectively with team members of varied work styles, to work independently, and demonstrated flexibility and creativity in planning and problem solving. A proven ability to learn quickly, take initiative and be accountable for results are important as well as an ability to understand the larger picture while remaining focused on the details, an even temperament, a good sense of humor and an awareness of and sensitivity to multi-cultural international development work.
